Water & Sewer Management LLC

By enrolling in a protection plan with Water & Sewer Management LLC (“Water & Sewer Management,” “WSMgmt,” “Water & Sewer Management Protection,” “Water & Sewer Management service contract(s),” “we,” “us,” or “our”), you (“you,” “your,” or “the customer”) agree to the following Terms of Service in full.
Water & Sewer Management provides residential water, sewer, drain, and limited interior plumbing service contracts for eligible properties located within designated service areas in Illinois. These plans are service contracts and are not insurance policies. Covered services, when approved and subject to the terms, limits, exclusions, and eligibility requirements set forth herein, may include sewer and drain services, sump pump and ejector pump services, water heater services (including tank-style units and tankless units on a case-by-case basis), plumbing fixture services, limited interior water supply line services, exterior hose spigots, and water main services, only as expressly determined, approved, and authorized by Water & Sewer Management. Water & Sewer Management does not repair, replace, service, reimburse, or cover any systems, components, conditions, damages, or costs not expressly included or approved.
Water & Sewer Management offers one protection plan billed at $129 per month. Coverage under the plan is subject to a $3,500 annual aggregate service limit per contract year. Any repairs, replacements, diagnostics, labor, materials, or services exceeding this annual limit are the sole responsibility of the customer and may be billed directly at prevailing market rates.
A $99 trip charge, visit fee, or inspection fee applies to each service request, regardless of diagnosis, approval, outcome, or whether any work is performed. Payment of the trip charge does not guarantee coverage, approval, or repair.
Coverage is available to residential property owners or tenants who are financially responsible for plumbing-related expenses at the covered property. Commercial, mixed-use, income-producing, multi-unit, HOA-controlled, and mobile or manufactured properties are excluded unless expressly approved in writing. Properties with shared sewer laterals may be reviewed and approved on a case-by-case basis at the sole discretion of Water & Sewer Management. Properties lacking proper access, including but not limited to accessible cleanouts, shutoff valves, or equipment access, are excluded from coverage.
All services eligible for coverage must be performed exclusively by vendors, contractors, or service providers selected, assigned, or approved solely by Water & Sewer Management. Customers do not have the right to select, request, substitute, or use their own contractor. Any work performed by non-approved contractors, homeowners, tenants, occupants, or unlicensed individuals is not eligible for coverage, reimbursement, or retroactive approval under any circumstance.
All service requests must be submitted through Water & Sewer Management’s claims process and approved prior to scheduling, including emergency requests. A 30-day waiting period applies from the date of enrollment before any services may be eligible for approval. Same-day enrollment and service requests are not permitted. Failure to mitigate damage, customer-caused delays, refusal to follow vendor recommendations, excessive service requests, misuse, foreign objects, slow drains, or customer unavailability may result in denial of coverage.
Coverage does not include normal wear and tear, gradual deterioration, corrosion, rust, material fatigue, aging components, sediment buildup, scaling, lack of maintenance, or failures resulting from ordinary or prolonged use. Coverage is further excluded for any damage, failure, or condition caused by customer tampering, attempted self-repair, modification, adjustment, misuse, or interference with any system or component, including work performed by homeowners, tenants, occupants, or non-approved contractors.
Recurring or repeat issues affecting the same system, component, or location are excluded from coverage, regardless of whether a prior service request was approved, denied, or performed. Frozen pipe damage is excluded unless piping was properly installed and insulated in accordance with applicable standards. Water pressure issues, noise complaints, vibration complaints, odor complaints without functional failure, backwater valves, irrigation or sprinkler systems, roof drains, downspouts, storm drains, septic systems, exterior plumbing other than hose spigots and water mains, and any utility-owned portions of sewer or water lines are excluded.
Excavation-related work, including but not limited to digging, trenching, concrete cutting, concrete replacement, flooring, drywall, cabinetry, landscaping, hardscaping, soil testing, engineering reports, asbestos handling, hazardous material abatement, mold remediation, water damage cleanup, restoration, or cosmetic repairs, is not covered. Code upgrades, permit requirements, and compliance with current building or plumbing codes are considered pre-existing conditions and are not covered.
Pump replacements, including sump pumps and ejector pumps, are limited to one replacement per system every ten years. Expansion tanks are excluded. Commercial-grade equipment installed in residential properties is excluded. Oversized or improperly installed equipment is excluded. Parts no longer manufactured may be substituted with comparable components at Water & Sewer Management’s discretion, including refurbished parts where appropriate. Water & Sewer Management reserves the right to repair or replace covered components at its sole discretion.
Water & Sewer Management reserves the right to deny, limit, or exclude coverage for fraud, misrepresentation, unauthorized repairs, pre-existing conditions, violations of these Terms, failure to follow claim procedures, inaccessibility, acts of God, governmental action, permit delays, utility company responsibility, or conditions outside the defined scope of coverage. In the event a service request is declined, Water & Sewer Management has no obligation to provide coverage, reimbursement, or service.
As a customer-service courtesy only, and at Water & Sewer Management’s sole discretion, Water & Sewer Management may offer an alternative assistance option whereby the customer may receive services with a reduced customer responsibility of up to 50% of the total repair cost, in lieu of the standard 90% customer responsibility applicable to non-covered services. This discretionary assistance does not constitute coverage, does not create precedent, and may be modified or withdrawn at any time.
Customers may cancel their plan at any time. A $129 cancellation fee applies to all cancellations to cover administrative and processing costs, regardless of membership length. Water & Sewer Management reserves the right to suspend or cancel coverage for non-payment, excessive claims, misrepresentation, or violations of these Terms. Pricing and terms may be amended with notice as permitted by law.
Any dispute, claim, or controversy arising out of or relating to these Terms, the protection plan, coverage determinations, services provided, or the relationship between the customer and Water & Sewer Management shall be resolved on an individual basis only. Class actions, collective actions, representative actions, and private attorney general actions are expressly waived. Except where prohibited by law, disputes shall be resolved through binding arbitration only if the customer voluntarily elects to pursue arbitration. The customer acknowledges and agrees that any arbitration filing fees, administrative fees, arbitrator fees, or related costs shall be the responsibility of the customer unless otherwise required by applicable law. Water & Sewer Management is not required to initiate or participate in arbitration unless legally obligated.
Water & Sewer Management LLC is registered to operate where required by law. All approved services are performed by independent third-party contractors who are appropriately licensed and insured where required. Water & Sewer Management is not responsible for the acts or omissions of such contractors beyond the scope of approved services. Personal information is collected, used, and shared with vendors as necessary to administer the plan, process claims, and provide services, including via phone, SMS, email, or recorded communications. Illinois law governs these Terms, and any permitted legal action shall be brought exclusively within the State of Illinois. Any claim must be brought within one week of the event giving rise to the claim.
By enrolling in or using any Water & Sewer Management plan, you acknowledge that you have read, understand, and agree to these Terms of Service in full.
